While the proposed fly ash rule exempts coal combustion products that are beneficially reused from the hazwaste regs, any fly ash that goes to the landfill must be managed as hazardous from the point of generation - regardless of whether it is "construction-grade" or not. There is a stigma that results from the hazwaste designation, warranted or not. EPA is in serious danger of destroying the markets for these valuable byproducts that have taken literally decades to build.
